In email marketing the future is often so yesterday, not so much a subject for speculation as reporting. So if you are wondering what the likely direction of email marketing is then look no further than the Canadian Fighting Internet and Wireless Spam Act (the Act).
Acronyms can be confusing, possibly one of their main reasons for their existence, and the one for the Act is a case in point. It is FISA. A search on the internet reveals an overwhelming and confusing list of motor racing headlines. And one cannot help but wonder what happened to the W.
Whilst specific to Canada the act has provisions which allow Canadian law enforcement agencies to work with their foreign counterparts to enforce the provisions. I feel a rather boring television series on the way.
The Act applies to – acronym alert – commercial electronic messages, or CEM, both in to and out of Canada so has implications to those outside the country as well as in. This is another example of individual governments making their own laws seemingly regardless of those of others. There really does need to be some uniformity.
Until that occurs, you will want to know the provisions of the Act. They are simple enough. You will need consent before sending a commercial email to a recipient inside Canada, or sending one from that country. However, there are a number of circumstances in which consent can be inferred.
The first is when there is an existing business or non-business relationship with the recipient. This does not mean any form of relationship and the provisions are defined in the Act. Both are quite specific.
A business relationship is when the recipient has bought or leased a product, goods or services, or bartered with you or entered into a contract. A non-business relationship is when a person donates to, volunteers for or becomes an official member of your organisation. So not such a liberal interpretation as one might have first thought.
It must be remembered that recipients classified under the above may still opt out of receiving email from you.
The second exemption is where the recipient has published their electronic address in a prominent manner. This is, of course, much wider and is only limited by the provision that the email must be related to the recipient’s professional capacity.
This same limitation relates to the third exemption: where the recipient has provided their address directly to the sender.
Put simply, those engaged in email marketing can send commercial email (CEMs) to anyone within the above exemptions provided they have not opted out/unsubscribed.
It is apparent that anyone running an email marketing business, at least outside Canada, must have segregated email lists with those from Canada having details of how the email address was obtained.
Penalties will make your mouth run dry: $1 million for individuals and $10 million for organisations. On top of that the Act gives provision for damages to be claimed. However, we are assured that the provisions are aimed solely at spammers and that if you can proved that you exercised ‘due diligence’ there will be no prosecution. Ensure your email marketing company is not the one which discovered whether this was a pious hope or not.
